Moka Holidays – Terms & Conditions

These Terms & Conditions govern all bookings made with Moka Holidays (“we”, “us”, “our”), including:

  • Private tours/hire of entire vehicle and tailor-made itineraries
  • Scheduled (seat-in-coach) day tours
  • Multi-day tours and travel packages

By making a booking with us, you agree to be bound by these Terms & Conditions.


1. Booking Contract

A contract between Moka Holidays and the customer (“you”) is formed when:

  • we receive your booking request;
  • we issue written booking confirmation; and
  • any required deposit or full payment has been received.

For group or scheduled departures, your booking is confirmed only once availability is allocated.

The lead booker confirms they are authorised to accept these Terms on behalf of all travellers.


2. Types of Tour

2.1 Private Tours

Private tours are exclusively for your party. Itineraries may be customised and are operated on a dedicated vehicle and driver-guide basis.

2.2 Scheduled Tours (Seat-in-Coach)

Scheduled tours operate on fixed departure dates and shared vehicles.

Key conditions:

  • Seats are subject to availability
  • Departure times and meeting points are fixed
  • Vehicles may include other passengers not in your group
  • Minimum numbers may apply for departure to operate
  • Itineraries are fixed and cannot be customised

We reserve the right to cancel or reschedule scheduled tours if minimum numbers are not met.


3. Booking & Payment

3.1 Deposits

Unless otherwise stated:

  • Private tours: 25% deposit required at booking
  • Scheduled tours: full payment may be required at booking or at time of confirmation

Deposits may be non-refundable where third-party costs have been secured.

3.2 Final Payment

Private tours: balance due 60 days before departure.

Scheduled tours: full payment may be required immediately or prior to departure, as stated at booking.

Failure to pay by the due date may result in cancellation without refund.

3.3 Pricing

All prices are in GBP. Prices may vary depending on supplier costs, demand, and availability.

Scheduled tour prices may use dynamic pricing based on departure date and availability.


4. Cancellations by the Customer

All cancellations must be made in writing.

Scheduled Day Tours (Seat-in-Coach)

  • More than 24 hours before departure: full refund
  • 24 hours or less before departure: 100% cancellation charge

Customers who fail to join a scheduled departure, arrive late, or miss the tour for any reason are not entitled to a refund.

Private Day Tours

  • More than 7 days before departure: full refund minus any non-refundable third-party costs
  • 7 days or less before departure: 100% cancellation charge

Multi-Day Private Tours & Tailor-Made Itineraries

  • More than 60 days before departure: deposit retained
  • 31–59 days before departure: 50% cancellation charge
  • 30 days or less before departure: 100% cancellation charge

Where third-party suppliers apply non-refundable charges (including accommodation, ferries, attraction tickets, or transport), these costs will be deducted from any refund.

We strongly recommend that all customers obtain comprehensive travel insurance.


5. Changes by the Customer

Private Tours

We will try to accommodate reasonable changes, subject to availability and supplier costs.

Scheduled Tours

Changes (including date changes) are treated as cancellations and rebooking and are subject to availability and pricing at the time of change.


6. Cancellations & Changes by Moka Holidays

We reserve the right to cancel or amend tours due to:

  • low passenger numbers (scheduled tours)
  • weather conditions
  • road closures
  • ferry disruption
  • supplier failure
  • safety concerns
  • force majeure events

Where possible, we will offer:

  • an alternative departure
  • a substitute itinerary
  • or a refund for unused services

We are not responsible for additional costs such as accommodation, transport, or flights.


7. Minimum Numbers (Scheduled Tours)

Scheduled tours require a minimum number of passengers to operate.

If minimum numbers are not reached, we may:

  • cancel the departure
  • offer an alternative date
  • offer a private upgrade (additional cost)
  • or provide a full refund

8. Itinerary Flexibility

Private tours:

  • itineraries may be adjusted due to conditions or customer preference (where feasible)

Scheduled tours:

  • itineraries are fixed and cannot be altered
  • timing and stops may vary due to operational conditions

All tours:

  • timings are approximate and may vary due to traffic, weather, or operational needs

9. Accommodation (Multi-Day Tours)

Accommodation is provided by third-party suppliers and subject to their terms.

Room configurations and special requests cannot be guaranteed unless confirmed in writing.


10. Inclusions & Exclusions

Unless stated, tour prices do not include:

  • attraction entry fees
  • accommodation
  • meals and drinks
  • optional extras
  • gratuities
  • personal expenses

11. Customer Responsibilities

You are responsible for:

  • arriving on time for departures 
  • holding valid travel documents
  • ensuring fitness to travel
  • disclosing relevant medical or mobility needs

We are not responsible for missed departures.


12. Missed Departures

No refunds are provided for customers who:

  • miss departure times
  • arrive late at meeting points
  • fail to join a scheduled tour once it has departed

13. Passenger Conduct

We reserve the right to remove passengers whose behaviour is disruptive, unsafe, or inappropriate.

No refund will be issued in such cases.

Smoking and vaping is not allowed in vehicles.


14. Children & Minors

Children under 18 must be accompanied by an adult.

Child seats must be requested in advance where required by law.

Children under 3 years of age are not permitted on scheduled tours.


15. Luggage

Luggage allowances vary depending on tour type.  If you are bringing luggage, please ask us about allowances in adavnce of your tour.

We accept no liability for lost or damaged belongings.


16. Travel Insurance

We strongly recommend comprehensive travel insurance covering:

  • cancellation
  • medical expenses
  • personal belongings
  • travel delays
  • missed connections

17. Force Majeure

We are not liable for failure to perform due to events beyond our control including weather, transport disruption, government restrictions, or supplier failure.


18. Liability

We act as an organiser using third-party suppliers and our own services.

We are not liable for indirect losses, missed connections, or events outside our control.

Nothing excludes liability for death or personal injury caused by negligence where legally applicable.


19. Photography & Marketing

We may use photos or videos taken during tours for marketing unless you opt out in writing before travel.


20. Complaints

Issues should be raised during the tour where possible.

Formal complaints must be submitted in writing within 28 days of tour completion.


21. Data Protection

We process personal data in accordance with UK data protection law and only for booking and operational purposes.


22. Governing Law

These Terms are governed by Scottish law and subject to the jurisdiction of Scottish courts.
